Regulations - Terms & Conditions


1. The following expressions used in the text of these Regulations have been assigned the following meanings.

1.1 Regulations - these Regulations of the Online Store (hereinafter Regulations) defining the rights and obligations of gamexshop and Customers related to the use of the Service, are the regulations referred to in Article 8 of the Act of 18.07.2002 on the provision of services by electronic means.

1.2 Online Store - is a website with the address www.gamexshop.com hereinafter referred to as the Online Store, operated by the Service Provider.

1.3 Service - a service provided electronically within the meaning of the Act of 18.07.2002 on the provision of services by electronic means, consisting of creating an Account at the Online Store, thanks to which the Customer gains the ability to conclude contracts for the sale of goods through the Online Store, to report complaints under the warranty for defects. In the case of Consumers, the Service is a contract concluded at a distance within the meaning of the Act of 30.05.2014 on consumer rights. The content of the contract consists of all functionalities of the Account and these Regulations.

1.4 Service Provider - www.gamexshop.com, email: bok@gamexshop.com The Service Provider is the Seller under the Sales Agreement.

1.5 Customer - a natural person who is at least 18 years old and has full legal capacity, a legal person, an organizational unit without legal personality, who has established an Account at the Online Store. The Customer is a Customer under the Sales Agreement. A person setting up an Account on behalf of a legal person or other organizational unit declares that he is authorized to act on behalf of that person.

1.6 User - a subject using the Online Store until logging into an Account on the Online Store.

1.7 Account - a subpage of the Online Store, available after the User registers on the Online Store website. After prior registration on the website of the Online Store. Within the Account available through the Web site, the Customer has the ability to place orders, add goods to the clipboard, check the status of his orders, make warranty claims for defects.

1.8 Commercial information - information about goods displayed in the Online Store. Commercial information on the price and availability of goods, at the stage before adding goods to the Cart and logging into the Account, do not constitute an offer within the meaning of the Civil Code, but only an invitation to start negotiations.

1.9 Clauses - consents in the form of so-called "check-boxes" within the form available on the website of the Online Store at the stage of registration in the Online Store, the ticking of which signifies consent to the content of these Regulations, and the Privacy Policy of the Online Store.

1.10 Working days: days from Monday to Friday excluding public holidays referred to in the Act of 18.01.1951 on Public Holidays.

1.11 Sales contract: a sales contract as defined by the Civil Code Act. In the case of Consumers, the contract of sale is a distance contract within the meaning of the Act of 30.05.2014 on consumer rights. The content of the contract consists of the order and the terms and conditions.

1.12 Offer - the content marked "Order Summary", displayed to the Customer after adding goods to the Cart and after logging into the Account.

1.13 Login: the User's e-mail address used when registering with the Online Store and each time logging into the Online Store.

1.14 Password: a set of alphanumeric characters necessary to authenticate the User when logging in to the Online Store. The password is determined independently by the User during registration at the Online Store.

1.15 Shopping Cart: an electronic form made available on the Online Store through which the User/Customer selects goods in order to place an order.

1.16 These Terms and Conditions are made available to be printed, downloaded, reproduced and recorded on the Online Store website, under the "Terms and Conditions" tab.

2 Technical requirements necessary for cooperation with the information and communication system used by the service provider.

2.1 Technical requirements to be met by the Service Recipient to use the Service: via the Website:

(a) connection to the Internet

b) correctly configured browser in accordance with the standards of Microsoft Internet Explorer version no lower than 5.5 or Opera, Firefox or Chrome in the highest version.

(c) screen resolution of at least 1024x768,

d) The Customer's computer must have the option to accept "cookies" enabled, an active JavaScript interpreter and flash plug-in installed,

e) active electronic mail (e-mail) account

3. terms and conditions for the conclusion and performance of contracts for the provision of services by electronic means.

3.1 All offered game accounts, activation codes and other offers are original and from official sources.

3.2 In accordance with Article.38 of the Law on Consumer Rights of May 30, 2014, digital content (keys, activation links, codes and steam gifs) are not returnable.

3.3 Before making a purchase, please familiarize yourself with the performance requirements of the software/game in question. Any problems arising from the hardware used cannot be the basis for a claim.

3.4 Most of the offers are handled by the automatic order shipping portal. The seller is not responsible for any delays caused by this service.

3.5 If the item for sale has not been marked for immediate shipment, then such an order will be delivered up to a maximum of 24 hours after receipt of payment. The Seller reserves the right to possible delays in the delivery of the order, which are caused by situations arising from random cases (lack of electricity, internet, etc.). The Seller will inform the Buyer about the reason for the delay.

3.6 The Seller is not responsible for misuse of the account/game/software by the Buyer, i.e. the use of various kinds of enhancers, unauthorized programs or prohibited activities, the effect of which is the imposition of a block on the account, game or software.

3.7 Accounts and keys may be dedicated only to a specific region, e.g. Turkey. All information on this subject is included in the description of the offer visible before purchase and in the post-purchase instructions (if any are included).

3.9 In the event of a complaint, the Seller declares a 24-hour response time. In the complaint, please describe the problem and attach photos or video, if the problem requires it.

3.10 If the payment is not recorded within 72h from the date of purchase, such transaction is considered by the Seller as not finalized.
